Welcome to HealHive! We operate a health-tracking web application (the “Service”) that empowers individuals recovering from surgery to log medications, track daily progress, monitor mood, and record pain levels.

The following Terms & Conditions (the “Terms”) govern your use of the Service. By accessing or using the Service, you agree to abide by these Terms. If you do not agree, you must stop using our Service.

1. About Us

2. Eligibility & Account Registration

Minimum Age: You must be at least 18 years old to create an account and use HealHive. We do not knowingly allow use by anyone under 18.
Account Registration: When registering, you agree to provide true, accurate, current, and complete information. You are responsible for maintaining the confidentiality of your username and password. You agree not to share or transfer your account. Any unauthorized use or suspected breach of security must be reported to us immediately.
Single Account: You must create only one account for personal use. Using multiple accounts or providing misleading data may result in suspension or termination.

3. Our Services & Licensing

Service Description: Our Service provides tools for logging, tracking, and visualizing personal health data around surgery recovery, including pain levels, mood, and optional medication tracking.
Limited License: HealHive grants you a non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use. All HealHive trademarks (logos, domain names, brand features) remain our sole property. Nothing in these Terms grants you any right to use our trademarks, whether for commercial or non-commercial purposes.
No Medical Advice: The Service is not a substitute for professional medical advice or treatment. You are solely responsible for verifying any health-related information with qualified healthcare providers. In an emergency, contact a medical professional immediately.

4. Subscriptions, Trials & Payments

Free Access: You can create a free account which offers basic health tracking features.
Paid Subscriptions: We may offer premium features or additional content through paid subscription plans. By choosing a paid plan, you agree to the pricing and billing terms presented to you at the time of purchase. Payment processing for subscription plans is handled by third parties (e.g., Stripe). We do not store full credit card details on our servers.
Free Trials: From time to time, we may offer free trials. If a trial is available, you’ll see the duration and specific terms before enrolling. If you do not cancel before the end of the trial, you will be charged for the chosen subscription plan.
Automatic Renewal: Paid subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing cycle. Renewal fees will be charged to your chosen payment method.
Cancellation & Refunds: You may cancel a subscription at any time. Cancellation takes effect at the end of your current billing period. Upon cancellation, you will retain access to paid features until your subscription term concludes, after which your account may revert to free status. Refunds are generally not provided once a transaction has been made, except where required by law or at our discretion. Subscriptions purchased via third-party app stores (e.g., Apple App Store, Google Play) are subject to those platforms’ respective refund policies.

5. User Conduct & Content

User-Generated Content (“UGC”): You may upload, post, or submit data, text, images, or other materials (collectively, “Content”). By submitting Content, you certify that you own the rights to it or are otherwise authorized to share it. You grant HealHive a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and distribute your Content in connection with providing and improving the Service.
Responsibility: You are solely responsible for all Content that you submit or share through the Service. If we determine that your Content violates these Terms or the law, we may remove or restrict access to it without notice.
Prohibited Actions: You agree not to use the Service for unlawful, fraudulent, or harmful purposes; upload or distribute viruses, spam, or harmful code; interfere with or disrupt the Service or its networks; impersonate any person or entity; or misrepresent your affiliation with a person or entity.
Monitoring & Enforcement: While we are not obligated to review all Content, we reserve the right to monitor, remove, or restrict Content that we deem inappropriate or in violation of these Terms.

6. Data Privacy & Security

Privacy Policy: Our Privacy Policy explains how we collect, store, and process your personal data. By using the Service, you also agree to our Privacy Policy.
Security: We implement standard security measures designed to protect your information. However, no system is completely secure, and we cannot guarantee that unauthorized third parties will not circumvent our measures.

7. Disclaimers & Limitations of Liability

No Medical Advice: HealHive does not provide medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional for medical questions or concerns.
Service “As Is”: The Service is provided on an “as is” and “as available” basis. We disclaim any warranties regarding the Service, whether express or implied, including any warranty of merchantability, fitness for a particular purpose, or non-infringement.
Limitation of Liability: To the fullest extent permitted by law, HealHive shall not be liable for any indirect, incidental, consequential, or special damages, including loss of data, revenue, or profits, arising from your use (or inability to use) the Service. In jurisdictions where limitations of liability are not permitted, our liability is limited to the maximum extent allowed by applicable law.
Assumption of Risk: You understand and agree that any actions you take based on information found through the Service are taken at your own risk.

8. Intellectual Property Rights

HealHive Ownership: All software, code, designs, text, graphics, and content published on the Service (excluding UGC) belong to HealHive or our licensors and are protected by intellectual property laws.
User Content: You retain ownership of any intellectual property rights you hold in your Content. By posting, you grant us the rights described in Section 5.
Trademarks: HealHive’s name, logos, and any associated brand features are our exclusive property. You may not use these without our prior written consent.

9. Third-Party Services & Links

External Services: The Service may contain links to or integrate with external websites or services (e.g., payment processors, analytics tools). These are provided for convenience and do not imply our endorsement.
No Responsibility: We are not responsible for content, policies, or actions of any third-party website or service. You use third-party services at your own risk and subject to their terms.

10. Termination

Termination by You: You may delete your account or stop using the Service at any time.
Termination by Us: We may suspend or terminate your account and/or access to the Service at any time, especially if we believe you’ve violated these Terms or engaged in unlawful activity. On termination, your right to use the Service ceases immediately. Certain sections of these Terms, such as Disclaimers, Liability, and Indemnity, will continue to apply.

11. Indemnification

You agree to defend, indemnify, and hold harmless HealHive, its affiliates, officers, directors, employees, and agents from all claims, damages, losses, liabilities, costs, or debt, and expenses (including attorneys’ fees) arising from:
• Your use or misuse of the Service.
• Your breach of these Terms.
• Any claim that your Content caused damage to a third party.

12. Modifications to These Terms

Right to Update: We may update or modify these Terms at any time. We will notify you of significant changes (e.g., by email or a notice on our site) before they come into effect.
Acceptance of Changes: By continuing to use the Service after changes become effective, you agree to the revised Terms. If you do not agree, you must stop using the Service.

13. Governing Law & Dispute Resolution

Governing Law: Depending on our final headquarters location, these Terms may be governed by and construed in accordance with the laws of [Insert Governing Law Jurisdiction], without regard to its conflict of law provisions.

No Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
